Indie Retail Challenge Terms & Conditions

OFFICIAL RULES  

HOW TO ENTER CONTEST  

Check in at five (5) independent retailers across Buncombe County during the month of July using the Explore Asheville App by clicking Indie Retail Challenge, visiting participating retailers and clicking Check In. Once you complete your 5 check-ins, you'll be automatically entered to win an Asheville Goodie Bag. Every additional check-in = an extra entry into the prize drawing. Winner will be drawn in early August and notified via email.

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Open only to legal residents of the US who are 18 years of age or older currently residing in one (1) of the fifty (50) US or D.C. Contest begins 12:00:01 p.m. ET on July 1 and ends July 31 (the "Promotion Period"). Void where prohibited.  

CONTEST PRIZE: One (1) winner will receive an Asheville Goodie Bag featuring local treasures.  The Prize includes:

• Two (2) Biltmore passes
• An East Fork mug
• Spicewalla 10-pack "Made With Love in Asheville" collection
• Local sourwood honey from The Bee Charmer
• Asheville Mix from Poppy Popcorn
• Asheville Grey tea by Asheville Tea Company
• Moonlight Makers tea towel
• A print from Horse + Hero.

RETAIL VALUE: $500. Prize must be redeemed by September 30, 2025.  

CONTEST WINNER NOTIFICATION: The Contest Winner will be notified at the email address provided upon registering with the Explore Asheville app. The Prize will be mailed to the Contest Winner at the address they provide upon responding to the winner notification email. Failure to provide mailing address within one week after initial request may result in forfeiture of Prize. Prize will only be mailed to addresses in the United States. Any mail or Prize which is returned as undeliverable will be forfeited.  Upon forfeiture for any reason, Prize will be awarded to the next randomly selected Contest Entry. Winner is responsible for all federal, state and local taxes and any other costs and expenses associated with Prize acceptance and use not specified herein as being provided. The Prize will be provided within fifteen days of the Winner providing all necessary information for the award to occur. The Winner agrees to release and hold harmless Explore Asheville from any liability related to the Contest or the Prize. 

GENERAL: Contest is subject to the laws of the United States only. Prize will be awarded and/or delivered only to an address within the United States. Except as explicitly set forth herein, Sponsor shall be responsible for the Contest, including all rules and determinations.  Except as determined by Sponsor in its sole discretion, no substitution of Prize is offered, no transfer of Prize to a third party is permitted, and non-cash prizes may not be redeemed for cash value. Any difference between stated approximate value of Prize and actual value of Prize will not be awarded. Prize Winner(s) will be solely responsible for all applicable federal, state and local taxes on Prize. Winner may receive an IRS Form 1099 for the retail value of the Prize. All other expenses on the receipt and use of a prize not specifically mentioned herein are solely the responsibility of the winner. Any portion of the Prize not accepted by Winner will be forfeited.  

CONDUCT: By entering this Contest, Entrants agree to be bound by these Official Rules. These Official Rules are accessible from the Web Site throughout the Promotion Period. Failure to comply with these Official Rules and/or the terms may result in disqualification. Sponsor reserves the right at its sole discretion to disqualify any individual suspected of tampering with the entry process or the operation of the Contest or the Web Site; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. Additionally, Sponsor will determine, in its sole discretion, whether a Winner is eligible.  CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS' FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

LIMITATIONS OF LIABILITY: Sponsor and/or All Participating Contest Parties assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Contest; (d) inaccessibility or unavailability of the Internet or the Web Site or any combination thereof, or; (e) any injury or damage to participant's or to any other person's computer which may be related to or resulting from any attempt to participate in the Contest or download any materials in the Contest. If, for any reason, the Contest is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest in whole or in part. If the Contest is cancelled or terminated, Sponsor will award the Prize by random selection of all eligible Entrants who submitted prior to the cancellation or termination.  

MISCELLANEOUS: Sponsor is not responsible for late, lost, incomplete, corrupted, stolen, garbled, damaged, delayed, undelivered or misdirected entries, all of which are void. Online entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry.  The authorized account holder must comply with these Official Rules. The authorized account holder is deemed to be the natural person  assigned to an e-mail address by the Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. By entering the Contest, Entrant recognizes and agrees that the registration information provided by Entrant will be made available to Sponsor. By accepting the Prize, Winner grants Sponsor and All Participating Contest Parties the right to print, publish, broadcast, and use universe-wide in any media now known or later developed, the winner's name, portrait, picture, voice, likeness, city and state of residence, and biographical information for any purpose, including but not limited to, in advertisements, publicity, and other communications, worldwide, in perpetuity, without additional compensation, notification or permission, except in TN and where prohibited by law. All entrants agree to comply with these Official Rules and the decisions of the Sponsor and judges shall be binding and final.  

RELEASE: As a condition of entering the Contest, Entrant agrees that (1) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (2) all causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form class action; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and in no event will any entrant be entitled to receive attorneys' fees. BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO RELEASE, DISCHARGE AND HOLD HARMLESS SPONSOR AND ALL PARTICIPATING CONTEST PARTIES AND THE RESPECTIVE OFFICERS, DIRECTORS, AND AGENTS OF EACH, FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, WHETHER DIRECT OR INDIRECT, WHICH MAY BE DUE TO OR ARISE OUT OF PARTICIPATION IN THE CONTEST OR ANY PORTION THEREOF, OR THE ACCEPTANCE, USE/MISUSE OR POSSESSION OF PRIZES, OR ANY PRIZE-RELATED TRAVEL OR ACTIVITY AND ENTRANT ASSUMES ALL ASSOCIATED RISK . EACH ENTRANT WAIVES ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  

DISCLAIMER: Sponsor and All Participating Contest Parties are not responsible for printing or typographical errors in these Official Rules or in any Contest-related materials. Sponsor reserves the right, in its sole discretion, to disqualify any individual that tampers with the entry process. Sponsor also reserves the right to terminate, suspend, cancel or modify the Contest and award the Prize (i) for the Contest from among all eligible, non-suspect Contest Entries received as of the date of termination in a random drawing if for any reason this Contest is not capable of running as planned due to any reason, including infection by computer virus, bugs, tampering, fraud, unauthorized intervention, non-authorized intervention, technical failures or other causes that may corrupt or impair the integrity, fairness or proper play of the Contest. Sponsor and All Participating Contest Parties are not responsible or liable for any events which may cause errors and/or the Contest to be stopped, including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, nor are they responsible for any problems or technical malfunction of any telephone, network or telephone lines, computer on-line systems, servers, or cable, satellite, or Internet Service Providers (ISP), computer equipment, software or any other failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Contest or downloading any materials in this Contest. Sponsor and All Participating Contest Parties are not responsible for computer, mechanical, technical, electronic, network or other errors or problems, including any errors or problems that may occur in connection with the administration of the Contest, the processing or judging of entries, or in any other Contest-related materials. The Sponsor may stop you from participating in this Contest if you violate Official Rules or act, in Sponsor's sole discretion: (a) in a manner Sponsor determines to be not fair; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor; or (c) in any other disruptive manner.  

CHOICE OF LAW AND JURISDICTION: Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants or winners, Sponsor, and administrator in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions (whether of the North Carolina or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the State of North Carolina. Any action seeking legal or equitable relief arising out of or relating to the Contest or these Official Rules shall be brought only in the courts of the State of North Carolina. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non-convenience or lack of personal jurisdiction they may have.
